Electronic Payment Authorization Terms

 

By checking the tick box and submitting this ACH payment, you are providing your electronic authorization and consent to the terms below:

You are requesting and authorizing Aiwyn, Inc. (Aiwyn) to act as a payment processor between You and a professional service provider (the Provider). You agree that Aiwyn is not responsible for the terms, delivery, or quality of services (the Services) that the Provider performs or agrees to perform for you.

You are providing your electronic signature as the deposit account holder of the personal deposit account or as an authorized signer on behalf of the business as the deposit account holder of the business account details entered into Aiwyn’s Online Payment Portal.

By submitting this payment, You have authorized ACH debits from the account details entered.

You are authorizing Aiwyn or its payment processing agent to initiate a one-time electronic fund transfer (ACH debit) from the bank account You have provided in the amount you entered.

These payments are governed by the Operating Rules and Operating Guidelines of NACHA, which regulate the ACH Network. You agree to be bound by the Operating Rules and Operating Guidelines of NACHA.

If Your bank account has ACH debit blocks, filters, or authorization controls (such as ACH Positive Pay), You are responsible for allowing ACH debits from Aiwyn (Company ID: 1810887694) prior to submitting this payment.

You are responsible for the data entered into this Web site and You are responsible for reviewing for inaccuracies all of the information transmitted to Aiwyn. If there are inaccuracies, You are responsible for those, and any applicable fees associated with returned or rejected payments may be passed on to You. 

You acknowledge and agree that any dispute you may have with the delivery, quality, quantity, accuracy, or value of the Services must be resolved between You and the Provider. You acknowledge and agree that any partial or complete refund of the payment you are authorizing must be provided to you by the Provider and not by Aiwyn. You agree that Aiwyn is not responsible for the manner in which Provider deposits, applies, or otherwise processes your payment.

You authorize Aiwyn to pay the amount you have entered to the Provider identified by the information you have entered, whether it is a Provider identifier, an invoice number, or otherwise.

Recurring ACH and Autopay

By enrolling in recurring payments or Autopay and/or have signed an Aiwyn ACH Recurring Payment Authorization Form (each a “ACH Recurring Payment Agreement”), You authorize Aiwyn, or its payment processing agents, to initiate recurring electronic fund transfers (ACH debits) from the bank account You provided.

These debits will be made in the amount(s), on the payment date(s), and at the frequency You have selected and confirmed in the payment details presented to You, including the amount, start date, and cadence, as well as as previously agreed to by You and the Provider in the applicable invoice, payment plan, or service agreement.

You understand and agree that any and all changes in the bank account You provided, including requests to terminate any ACH Recurring Payment Agreement, must be in writing and be delivered to Aiwyn, at the above address, at least 10 business days prior to the next due date specified within the ACH Recurring Payment Agreement (“Payment Due Date”). If the Payment Due Date falls on a weekend or holiday, You understand and agree that the payment may be executed on the next business day;

You understand and agree that as this is an electronic transaction, adequate funds must be available for withdrawal from the bank account You provided by the Payment Due Date. In the case of an ACH transaction being rejected for Non Sufficient Funds (NSF), submission error, or other bank related return reasons, You understand and agree that Aiwyn may at its discretion resubmit the ACH debit transaction within thirty (30) days up to two additional times, as permitted by NACHA Rules. Applicable returned payment fees may be assessed for each returned ACH debit, and You acknowledge that the origination of ACH transactions to the bank account You provided must comply with provisions of U.S. law. You agree not to dispute an ACH debit with Your bank if the debit was authorized by You and processed in accordance with this Agreement or any other agreement between You and Aiwyn. This does not limit Your rights under applicable law to dispute unauthorized transactions.

Providing Notice of Revocation

If you would like to have your auto pay authorization revoked please provide notice of revocation to Aiwyn by sending an email to support@aiwyn.ai.
